On July 6, 2022, the DOL released guidance on how to request a letter of support from the agency for workers involved in labor disputes (i.e. trying to assert their workplace rights). The guidance outlines how to request a letter of support from DOL: the email address to send the request, the information to provide, and the factors that DOL will consider when deciding whether to issue a letter of support.
- The FAQ is currently available in English and Spanish. DOL plans to translate the FAQ into Cantonese, Mandarin, Tagalog, Vietnamese, Korean, Zapotec and Mixteco.
- The DOL does NOT want information on individual workers’ particular immigration histories or needs or personally identifiable information. They issue the support letters worksite-wide.
What we are still pushing for:
- DHS ultimately has the power to grant deferred action or parole, but they have not yet issued their guidance to clarify how they will handle these requests. We need to put pressure on DHS to ensure that they publish the guidance!
- Cases from domestic workers are important in building this process and making sure that it works for domestic workers. NDWA is looking for cases from our network and ready to partner with and support you in bringing cases.
